Civil Justice for Survivors of Sexual Assault

If you’ve survived sexual assault, you deserve more than just silence — you deserve justice. At Vandamme Law Firm, we represent survivors in Albany and across upstate New York in filing civil lawsuits against perpetrators and institutions that enabled abuse. Whether criminal charges were filed or not, a civil suit can help you regain power, secure compensation, and hold wrongdoers publicly accountable.

Civil Lawsuits Are a Powerful Tool for Survivors

Unlike criminal cases, civil lawsuits are brought by you — the survivor — not the state. You can seek financial compensation for the harm you've suffered, including emotional trauma, medical bills, lost wages, and more. You may also shine a light on institutional failures, like schools, religious organizations, or employers that failed to protect you.

Even if no criminal charges were filed, survivors can still pursue justice through a civil lawsuit. If you’re unfamiliar with how these processes differ, check out our guide to civil vs. criminal cases to learn more.

New York law has recently expanded access for adult survivors to file claims, even if the abuse occurred years ago. We handle your case with discretion, compassion, and fierce advocacy.

Types of Civil Sexual Assault Cases We Handle

Fighting for Justice, Even Years After the Abuse

Campus or School-Related Assault

We represent college students, high school students, and others assaulted on school grounds or by educators. Institutions often fail to investigate or act — and can be held liable for those failures.

Workplace Sexual Assault

Some cases involve supervisors, coworkers, or customers who cross the line. We help employees pursue both the individual and the employer if harassment or assault was ignored or enabled.

Institutional Abuse

Survivors of clergy abuse, youth programs, or group homes often struggle to be heard. Our firm helps bring long-overdue accountability to powerful institutions that allowed harm.

Assault by Trusted Professionals

Whether by a doctor, therapist, coach, or landlord, abuse by someone in a position of authority or trust is deeply traumatic — and legally actionable. We pursue claims with care and discretion.

Albany Sexual Assault Civil Lawsuit FAQs

  • Can I still file a civil case if criminal charges were never filed?

Yes. The civil system is separate from the criminal system, and you don’t need a criminal conviction to bring a lawsuit.

  • What is the Adult Survivors Act?

It was a one-year lookback window (closed in November 2023) that allowed adult survivors to file civil claims no matter when the assault occurred. However, you may still have a case depending on your circumstances — especially if the assault was recent or ongoing.

  • Will I have to testify in court?

Most cases settle before trial. If your case does go to court, we’ll prepare you fully and protect your privacy as much as possible.

  • What damages can I recover?

You may recover compensation for pain and suffering, therapy costs, medical bills, lost wages, and more. In some cases, punitive damages are also available.
